We’re scanning the house amendments, and will do a series of posts summarizing what they’ve done but general issue area. Our first post concerns taxation.

Items that reduce state revenue

  • Eliminates the estate tax
  • Extends the Historic Preservation Tax Credit for $25 million per year
  • Clarifies the wide-ranging privatization provisions of the bill to exempt vendors of privatized state services from the sales tax, income tax and commercial activity tax. This appears to also mean that vendors will continue to be required to pay local taxes, including property taxes on privatized prisons.

Items that (arguably) increase state revenue

  • Defines casino gross revenue for purposes of collecting the Commercial Activity Tax to mean all amounts wagered, before winnings are paid out to patrons (this is arguably a tax increase because the Tax Department already believed this was the basis for applying the CAT to casinos, but the Governor appeared to be confused)

Revenue-neutral provisions (for the state)

  • Earmarks $50 million of CAT revenue for grants to local governments who agree to share services.
